These Terms of Service govern purchases made through Buddha-Statues.com. By placing an order, you agree to these Terms. Nothing in these Terms limits any mandatory rights you have under applicable consumer law.

2. Products and descriptions
We sell antique, vintage and collectible Buddhist sculpture and related objects. Many objects are unique and may show age-related wear, patina, repairs, losses, cracks, corrosion, surface variation or other characteristics consistent with their history. These characteristics are not defects when they have been disclosed in the description or are clearly visible in the photographs.
We describe each object in good faith using the information and professional assessment available to us. Dating, origin, attribution and material identification may involve informed scholarly or professional opinion unless expressly stated to be supported by definitive documentation. Product photographs form part of the description, although colours and scale may vary between screens.
3. Prices, VAT and other charges
Prices shown at checkout are the prices applicable to the selected destination and include VAT where required. For exports outside the European Union, EU VAT may be zero-rated where the legal requirements for export are met.
Shipping charges and any other charges collected by us are shown before the order is submitted. Import duties, customs taxes, brokerage fees and local taxes imposed by the destination country are not included unless checkout expressly states that duties are included.
4. Orders and contract formation
Submitting an order is an offer to purchase. A binding sales contract is formed when we send an order confirmation accepting the order. We may decline or cancel an order before acceptance where an object is unavailable, the price or description contains a material error, payment cannot be authorised, shipping is not reasonably possible, or legal and compliance requirements cannot be satisfied. If payment has already been collected for an order we do not accept, it will be refunded.
Because most objects are unique, placing an item in a cart does not reserve it until the order has been accepted.
5. Payment
Payment must be made using a method offered at checkout. The customer confirms that they are authorised to use the selected payment method. We may carry out reasonable fraud-prevention and identity checks before dispatch.
6. Shipping and delivery
Available shipping methods, prices and estimated delivery times are shown at checkout or communicated before purchase. Delivery dates are estimates unless we expressly agree otherwise. We are not responsible for delays outside our reasonable control, but mandatory consumer rights regarding delayed delivery remain unaffected.
The customer must provide a complete and accurate delivery address and cooperate with reasonable carrier or customs requests. Additional costs caused by an incorrect address, refusal of delivery, failure to provide customs information or failure to collect a shipment may be charged to the customer to the extent permitted by law.
7. International orders, customs and DAP delivery
Unless checkout or our written quotation expressly states DDP (Delivered Duty Paid), international orders are supplied DAP (Delivered at Place). Under DAP, the recipient is the importer of record and is solely responsible for import duties, customs taxes, local taxes, brokerage or clearance fees and any other destination-country charges.
These charges may be collected by customs authorities or the carrier before delivery. Refusing a shipment or failing to pay import charges does not automatically cancel the order. Any recoverable return freight, customs charges, storage fees or carrier charges may be deducted from a refund where permitted by applicable law.
We provide customs documentation in good faith using the actual transaction value, the known country of origin and an appropriate product description. We do not undervalue shipments or mark commercial purchases as gifts.
8. Transfer of risk
For consumers in the European Union or where mandatory consumer law provides equivalent protection, risk passes when the customer or a person designated by the customer physically receives the goods. If the customer independently appoints a carrier not offered by us, risk may pass when the goods are handed to that carrier, as provided by applicable law.
9. Right of withdrawal and returns
Consumers who have a statutory right of withdrawal may cancel an eligible distance purchase within 14 days after receiving the goods, without giving a reason. Instructions, exceptions, return conditions and the model withdrawal information are provided in our Returns & Refunds policy, which forms part of these Terms.
The customer must handle an object only as necessary to establish its nature, characteristics and functioning. The customer may be responsible for diminished value caused by handling beyond what is necessary. Return shipping costs are borne as stated in our Returns & Refunds policy and applicable law.
Statutory withdrawal rights and statutory remedies for non-conforming goods are separate. Nothing in our returns policy removes rights that cannot legally be excluded.
10. Inspection, damage and complaints
Please inspect the shipment promptly after delivery. Visible transit damage should be photographed, retained with all packaging and reported to us as soon as reasonably possible so that we can assist with a carrier claim. A failure to report immediately does not remove mandatory consumer rights.
Complaints may be sent to sales@1stbuddha.com. Please include the order number, a description of the issue and relevant photographs. We will respond within a reasonable period.
11. Legal guarantee and conformity
Consumers benefit from the mandatory legal guarantee of conformity applicable to their purchase. Remedies may include repair, replacement, price reduction or termination where legally available. For unique antique or collectible objects, replacement with an identical object may be impossible; this does not affect any alternative remedy required by law.
12. Authenticity and provenance
Our approach to research, dating and authenticity is explained on our Authenticity page. Any object-specific written guarantee or certificate supplied with an object prevails over general website wording for that object. Provenance information is provided to the extent known and may be limited to protect legitimate privacy interests.
13. Website use and intellectual property
Website content, including text, research, photographs, graphics and branding, belongs to 1STBUDDHA OÜ or its licensors and may not be reproduced or commercially used without prior written permission, except where permitted by law.
You may not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious code or use the website for unlawful purposes.
14. Liability
We are responsible for loss and damage caused by our breach of contract or negligence to the extent required by applicable law. We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer remedies.
To the extent permitted by law, we are not responsible for indirect or unforeseeable loss, loss caused by incorrect customer information, destination-country import decisions, or events outside our reasonable control. Customers purchasing in the course of a business must inform us before ordering if special contractual requirements apply.
15. Privacy
Personal data is processed in accordance with our Privacy Policy. Payment providers, carriers and customs intermediaries may receive the information necessary to process payment, deliver orders and complete customs formalities.
16. Governing law and disputes
These Terms are governed by the laws of Estonia. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country in which you habitually reside. Consumers may bring proceedings in any court available to them under mandatory applicable law.
We encourage customers to contact us first so that we can attempt to resolve any dispute directly. Where applicable, consumers may also use a competent national consumer dispute-resolution body.
17. Changes to these Terms
We may update these Terms from time to time. The version applicable to an order is the version made available when the order is placed. Changes do not retroactively alter an existing contract unless required by law or agreed with the customer.
